Terms and Conditions

By submitting your registration for any program or class (including but not limited to any trial class or audition) conducted by Fable Dance Company, you acknowledge that you have read, understood and agreed to be bound by these terms and conditions.

 

1. Register

a.     Students will only be allowed to attend any program or class upon full payment of all applicable fees.

b.     Registration may be open for programs or classes which have already commenced at the sole discretion of Fable Dance Company. Fees will be pro-rated accordingly.

c.     Registrations are not transferrable to any other person.

2. Withdrawal and No Refund

a.     No refund of any fees will be made for any class missed by a student under any circumstances.

b.     No refund of any fees will be made for any withdrawal by a student from any program. A request for refund may be submitted to Fable Dance Company if the reason for withdrawal is due to medical reasons supported by certified medical documents. Fable Dance Company reserves the right to accept or reject any request for refund after assessing the circumstances on a case-by-case basis and its decision will be final.

3. Conduct of Students

a.     Students must diligently follow and observe all rules, guidelines of etiquette, discipline, conduct, attire, and procedure set by Fable Dance Company from time to time.

b.     Students are required to observe punctuality in attending classes. Late comers without valid reasons may not be permitted to join the class.

c.     Fable Dance Company reserves the right to terminate a student from any program if he/she, in Fable Dance Company’s sole opinion, does not show seriousness during class, has discipline problems and/or fails to meet any of the program requirements. There will be no refund of any fees.

4. Classes

a.     Fable Dance Company reserves the right to change or cancel a scheduled class, or to change the instructor, when necessary.

b.     A cancelled class will be re-scheduled by Fable Dance Company. This may be rescheduled to a different day and/or a different time from when the class was originally scheduled.

5. Indemnity

a.     Every care will be taken to ensure the wellbeing of the students during class. However, classes may be physically strenuous, and participation is based on an understanding and knowledge that there is risk of personal injury. Fable Dance Company shall not be liable for any loss, damage, injury, death, penalty, cost, expense and/or any other consequences fully arising from and/or in connection with any of its classes or programs as may be permitted under the applicable laws and regulations.

b.     You agree at all times to indemnify and hold harmless Fable Dance Company, its management, members and staff against all losses, liabilities, claims, actions, proceedings, orders, penalties, and costs (including legal costs on a full indemnity basis) howsoever arising in connection with these terms and conditions.

6. Intellectual Property

a.     All exercises, class sequences and materials taught in class remain the property of Fable Dance Company. They cannot be taught (or performed) outside the studio without the prior written approval of Fable Dance Company.

b.     Prior approval by Fable Dance Company must be granted before any form of recording (photography or video recording) may be taken. All recording (photographs and videos) shall be for personal use only and not for any commercial use.

7. Data Protection

a.     You agree that you have read, understood and consent to Fable Dance Company collecting, using, disclosing, and processing your personal data in the manner set forth in our privacy policy. By attending our classes, courses and/or programs you agree to our collection, use and/or disclosure of your personal data to the extent necessary to process your requests and provide you with our services.

8. Waiver and Release

a.     You understand, acknowledge and agree that due to the nature of the dance sport, including pole, aerial, dance and stretch classes, practices and related activities conducted by Fable Dance Company carries inherent dangers and risks, including risk of injury or death.  You acknowledge that you need to submit a parental consent letter to Fable Dance Company if you are under 18 years old before enrolment. You further agree that participating in any activity organized or conducted by Fable Dance Company is purely on your sole volition and risk. You agree that while classes or other are in session, it may not be possible or practical for the instructors of Fable Dance Company to provide safety instructions and recommendations. You acknowledge that you are at liberty to at any time to cease or suspend your participation if you are in any way incapacitated, unable to continue or feel that any activity may result in bodily injury to yourself or other participants. Should you decide to continue despite such conditions, any encouragement, recommendations or advice given by the instructors of Fable Dance Company does not negate the voluntary nature of your decision.

b.     In view of the aforesaid, and by your voluntary participation in the activities of Fable Dance Company, You hereby, to the full extent permitted by law, WAIVE ALL LEGAL RIGHTS OF ACTION AGAINST AND FULLY RELEASE FABLE DANCE COMPANY, its directors, instructors, employees, agents, landlords, leases or franchisees (Related Parties) for the loss, damages, or injury howsoever arising out of or in relation to the participation by yourself in the activities conducted or organized by Fable Dance Company including without limitation, liability for any negligent or tortious act or omission, breach of duty, breach of contract or breach of statutory duty on the part of Fable Dance Company and/or Related Parties.

9. Health and Conduct

a.     You understand and acknowledge the dangers associated with the consumption of alcohol or any mind altering drugs before and during the activity and you take full responsibility for any injury, loss or damage associated with their consumption. You  agree not to drink alcohol or take drugs prohibited by law before or during in any activities conducted or organized by Fable Dance Company.

b.     You acknowledge that you have been advised to consult with your physician with respect to any past or present injury, illness, pregnancy or any other health related condition or any kind whatsoever that may affect your participation and ability to participate in the program. You acknowledge that you have discussed the appropriateness of pole, aerial and other dance programs in connection with any illness or condition that you have or have had with your physician, and that you knowingly execute this release from liability and negligence. Specifically, and without derogation to the foregoing, you acknowledge that Fable Dance Company has recommended that pregnant women DO NOT participate in pole and aerial classes.

10.  Personal property

a.     You recognize and accept that you are solely responsible for your personal belongings and property. You waive and release any and all claims against Fable Dance Company for property loss or damage to your personal property arising from your participation.

11.  Cancellation of Classes

a.     Fable Dance Company reserves the right to change or cancel a class up to and including the date of the course if sufficient bookings have not been received. In the event of a class or course being altered or cancelled every effort will be made to avoid inconvenience by offering alternative dates, times or venues. You agree to try to accept all reasonable changes made by Fable Dance Company, but nonetheless agree that in the event of a cancellation or postponement initiated by Fable Dance Company, the maximum liability of Fable Dance Company is limited to a full refund of the cancelled class or activity.

12.  Class placements, Transfers and Refunds

a.     Once payment has been processed, you are booked for the class you have specified. Thereafter, an administrative charge of $22 applies each time you make a class transfer. This applies to transfers to another level or transfers to another class timing within the level. No postponement of class and refunds allowed.

b.     Any persons unable to complete their course due to illness or injury must inform Fable Dance Company with a medical certificate for review, before the term course ends. Refunds or credit notes will only be given in exceptional cases, at studio’s discretion. No refunds of missed classes. Package rate will not apply for refund cases. You understand that refunds, or the transfers of fees to another term and/or other students, will not be granted in any circumstances except as specifically stated in these Terms and Conditions.

13.  Class Makeup

a.     You may withdraw classes and arrange for a makeup session up to 12 hours prior to the missed class via your student account. Makeup for term course(s) must be done within the same term; Makeup for practice and workshops within 1 month from withdrawal date. Unused credits will expire without further notice.

14.  Practice 

a.     For safety reasons, you understand that you are not allowed to teach or learn of tricks with other students of another level or anyone outside of the studio at practice sessions. Please approach staff for any aerial equipment change or height adjustments. Incorrect handling may result in equipment failure or injuries.

15.  Private Classes

a.     You may have up to 3 participants in each lesson. Please contact your instructor to schedule your private session. Private Class Pack is expires in 3 months/ Single Private Class expires in 45 days from the date of purchase. Balance credits will be forfeited when due and unutilised. Class will also be forfeited if 'no show', or cancellation is not made 48 hours before class, or 5 days before if class is set at peak hours (weekends all-day, Mon-Fri 12:00-2:30pm, 6:00-9:00pm). Full payment is to be made at least 48 hours before private lesson takes place to confirm the session. Any persons unable to complete their package due to illness or injury must inform Fable Dance Company at www.fable.dance/message with a medical certificate for review, before the private package expires. Extensions will only be given in exceptional cases, at Fable Dance Company’s discretion.

16.  Private Parties

a.     Booking date is subjected to studio availability at the time of payment. An email confirmation will be sent to confirm your booking date/time upon receipt of full payment. Full payment to be made 7 days before actual event. No refund for 'no show' or cancellation made after payment. Cancellation must be made 72 hours before event date/time at www.fable.dance/message otherwise 50% of payment will be forfeited.

17.  Bringing your own aerial equipment and rigging

a.     The use of student’s own hammock is allowed.

b.     Hammock may be attached to student’s own hitches and/or carabiners.

c.     If using own hitches, they should be connected to student’s own carabiners, then connected to student’s own spreader plate. Note - ONE hitch to ONE carabiner. DO NOT load 2 hitches on 1 carabiner. Ensure hitch fabric do not get caught in carabiner gate.

d.     Student will bear full responsibility of consequences in the event of their equipment failure.

e.     Student is responsible for rigging and inspecting their own equipment.

18.  Instructors taking classes at Fable Dance Company

a.     Pole / Aerial / Dance instructors are welcome to enrol in Fable Dance Company courses but priority is given to amateur learners. In the eve that classes are oversubscribed, customers who are instructors may be asked to give up their slot with a full refund before the course starts.

19.  Amendments

a.     Fable Dance Company reserves the right to review and/or amend any term in these terms and conditions from time to time as it deems fit. Any amendments to these terms and conditions will be notified to you in any manner as Fable Dance Company may decide two weeks prior to such amendments taking effect.

20.  Governing Law

a.     These terms and conditions shall be governed by and construed in accordance with the laws of Singapore.
